Terms and Conditions
USE OF THE APPLICATION (AS DEFINED BELOW) MEANS YOU (THE „CUSTOMER“) HAVE READ, UNDERSTAND AND UNCONDITIONALLY AGREE TO THESE TERMS & CONDITIONS.
SkyMinder for Salesforce (the “Application”) provides access to the Skyminder Service within the Salesforce Platform.
Customer is licensed to use the Application solely for accessing the Skyminder Service within the Salesforce Platform. Access to the Skyminder Service through the Application requires an existing SkyMinder Service subscription with the Data Provider.
INTERCODEC (the Application Provider) does not guarantee the accuracy or relevance of the data provided by Data Provider and is not responsible for any damages arising from the use of these data. We do not guarantee availability of the Skyminder Service or the successful sending and receiving of the data. The Application Provider reserves the right to restrict service without notice.
By using the Application Customer agrees with sending and receiving data. The Customer is solely responsible for the use of the data provided through the Application. The Customer shall not violate any applicable laws or terms and conditions imposed by the Data Provider for the use of the SkyMinder Service.
Upon Customer’s subscription of the relevant contract with the Data Provider, the Data Provider will issue to Customer a confidential username and password for authorized use and access to the Skyminder Service through the Application by a Customer.
Customer acknowledges that the Application may become inaccessible as a result of suspension, termination or expiration of Customer’s existing contract with the Data Provider and that Customer shall not, in such event, be entitled to any refund or compensation from Data Provider or Application Provider.
Customer acknowledges and agrees that once Data Provider’s data are integrated into the Application, Data Provider or the Application Provider has no responsibility or liability for any aspect of the Application, including storage, maintenance, retention, accessibility, security, or charges governed, if at all, by Customer’s agreement with Salesforce.
4. Salesforce Licenses
Customer acknowledges that the Application may become inaccessible as a result of suspension, termination or expiration of Customer’s existing license(s) with Salesforce and that Customer shall not, in such event, be entitled to any refund or compensation from Data Provider or Application Provider.
When using the Application, data encompassed under “Accounts” object are shared only with Data Provider for the purpose of performing queries on the SkyMinder Service. The information is not provided to third parties or Application Provider.
6.Limitation of Liability
Customer assumes all risk associated with the installation and use of the Application. In no event shall Data Provider or Application Provider be liable for claims, damages or other liability arising from, out of, or in connection with the Application. Customer is solely responsible for determining the appropriateness of use and assume all risks associated with its use, including but not limited to the risks of Application errors, loss of data or unavailability or interruption of operations.
“Data Provider” - means CRIF S.p.A. with registered office at Via M. Fantin 1-3, 40131 Bologna, Italy
“Application Provider” - means INTERCODEC CZECH s.r.o. with registered office at Chotěšovská 680/1, 190 00 Praha - Letňany, Czech Republic
SkyMinder Service” - means the SkyMinder service, as available and described at http://www.skyminder.com, through which the Data Provider offers business information and report on business entities in 230 countries and territories around the world.
“Salesforce” - means salesforce.com, inc., cloud-based CRM system provider headquartered in San Francisco, USA
“Salesforce Platform” - means the portfolio of Salesforce's cloud-based products for sales, service, marketing, collaboration and communities.
